ICC issues arrest warrants for two Taliban leaders over persecution of women

The International Criminal Court (ICC) issued arrest warrants Tuesday for Taliban Supreme Leader Hibatullah Akhundzada and Abdul Hakim Haqqani, head of the Afghanistan Supreme Court.

The warrants were announced in a statement by the ICC’s Office of the Prosecutor.

“Based on evidence presented by the Office, the judges found that there are reasonable grounds to believe that they have committed — by ordering, inducing or soliciting — the crime against humanity of persecution, under Article 7(1)(h) of the Rome Statute, on gender grounds, against girls, women and other persons non-conforming with the Taliban’s policy on gender, gender identity or expression; and on political grounds against persons perceived as ‘allies of girls and women,’” the statement read.

ICC Chief Prosecutor Karim Khan, who has been under fire for issuing arrest warrants in November against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant, called for the warrants against the two Taliban leaders in January.

According to the Associated Press, the ICC reopened an investigation into crimes against humanity in Afghanistan in 2022 with Khan’s approval. The Taliban retook the country in 2021 following a deal made during the Trump administration’s first term.

The warrants were announced shortly after the United Nations adopted a resolution calling on the Taliban to “reverse their worsening oppression of women and girls and eliminate all terrorist organizations,” according to the Associated Press.

The move was condemned by Zabihullah Mujahid, the Taliban’s chief spokesperson, saying the ICC is in “open hostility and hatred towards the holy religion of Islam and Shariah Law.”
